Prosecutors reject CHP recommendation to charge La Habra police officer in car crash deaths

A La Habra Police Department officer will not face criminal charges in an accident that killed two people last year, even though investigators suggested manslaughter charges.

On April 5, 2009, Charles and Susanne Antuna were driving their Chrysler PT Cruiser to church to hear their daughter sing in a musical. The La Habra police officer was racing in her patrol car to help other officers in pursuit of a wanted parolee.

At the intersection of Euclid Street and La Habra Boulevard, the two cars collided. Susanne Antuna, 55, died at the scene. Charles Antuna, 54, died at a hospital.

The California Highway Patrol concluded the officer, Nancy Garcia, was driving 62 mph in a 35-mph zone. The CHP suggested to Orange County prosecutors that vehicular manslaughter charges be filed.

But the San Gabriel Valley Tribune reported that prosecutors declined to file charges. La Habra police are continuing their own investigation.
