San Jose police have arrested a 35-year-old man on charges that he kidnapped a 5-year-old girl playing on her front lawn and then took her to his home where he sexually assaulted her, before finally releasing her.
Phillip Michael Dominguez was arrested about 11:30 a.m. Tuesday where he had been staying near Senter Road and Feldspar Drive in San Jose, according to police reports.
In a statement, police said Monday that the girl was playing in front of her home on Balfour Drive when she was “forcibly” taken from the front yard and later molested.
Police spokesman Dirk Parsons said commanders do not want to release whether Dominguez knew the girl or not, saying the relationship was “under investigation.”
Police say they quickly figured out that Dominguez was the suspect, but he had fled the scene. Through tips, police found Dominguez the next morning.
He does not have a criminal record in Santa Clara County. And he has never been charged with any sex crime, according to a search on the Meghan’s Law database.
His girlfriend, Racquel Martinez, 29, was also arrested on suspicion of aiding and abetting. Both Dominguez and Martinez were booked into the Santa Clara County Main Jail in San Jose. Neither have been formally charged yet by the Santa Clara County District Attorney’s Office, which has not yet received the case.
