Justice for birthday rape victim six years later

PETALING JAYA: What was to be a joyous birthday celebration for a 21-year-old turned tragic when she was raped by a friend.

Justice finally came six years later when her assailant, a bank customer service officer, was sentenced to seven years jail and three strokes of the rotan by a Sessions court here today.

Ahmad Muhaimin Abdullah, 27, was found guilty under Section 376 of the Penal Code by sessions judge Rozina Ayob for raping the college student on Dec 28, 2004, at 3pm in a rented room of a condominium unit at Block 1, Pangsapuri Seri Pelangi, here.

Rozina found the defence had failed to raise any reasonable doubt against the prosecution’s case which proved there was no consent involved and that there was an act of penetration.

“I find the accused’s defence to be a creation, an afterthought and a bare denial,” she said in her judgement, adding the fact that the accused tried to flee when police arrived at the scene indicated Ahmad Muhaimin’s guilt.

The accused, wearing a black jacket and jeans, appeared calm as the verdict was read out and nodded when asked by the judge if he understood the sentence meted out on him.

Rozina said even though the victim never screamed for help during the ordeal, it was clear she had not given her consent to sexual conduct by the accused.

She said the victim’s testimony of penetration was collaborated by the doctor who examined her and found fresh tear at the victim’s private parts which was consistent with rape.
